1. Michael C Donaldson, Esq. Donaldson and Hunt asserts fair use via email for 7.1 and 7.2 (2 pages)

Our practice is national. We have a lot of east coast clients including
IFC. I would be delighted to come with you guys. On your paperbacks,
the shots may be fair use. See this articles and the fair use chapter
in the book. Good luck.

Michael,

Thanks very much for the good news. I feel a guilty thrill getting
gratis guidance from a competent lawyer! I’d better retain a
clearance attorney so you don’t have to get any more emails from
me… I am based in Brooklyn NY, can you make a recommendation?

In the meantime, if you’ll indulge me just once more, I have a final
clearance question – what about a shot that prominently shows the
covers of several vintage paperbacks? Could you point me in the right
direction for clearing that sort of material?

Again, much thanks!

You bet it is a clearance question. However, you are in the clear on
this one. It certainly is permissible to make such a reference
whether
the author is living or deceased.

Good luck with your screenplay.

Hi Michael,

I bought the 2nd edition of Clearance and Copyright, Everything the
Independent Filmmaker Needs to Know, and have a question. If, in a
screenplay, a character mentions two book titles written by a
deceased author and the name of the author, is that a clearance
issue? For example,

CHARACTER A
“title A, title B, authors name, do you like him?”

CHARACTER B
“my uncle did.”

I appreciate your book, thanks!
